Our General Terms and Conditions of Sale

This site is published by the company Kid Medical SARL with a capital of 1,000 euros whose registered office is located at ZA de Beauvent 22980 LA LANDEC, registered with the RCS of ST MALO, under the SIREN number: 807 778 055.

These terms and conditions of sale govern the procedures for placing orders on the Bed Wet website. Kid Medical reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the terms and conditions of sale in effect at the time the order is placed will apply.

It is hereby specified that these terms and conditions govern sales made by Kid Medical of products offered on the website called: Bed Wet Store

 

ARTICLE 1 - VALIDATION

You acknowledge that you have read and accepted these terms and conditions of sale before placing your order. Therefore, validating your order constitutes acceptance of these Terms and Conditions of Sale.

 

ARTICLE 2 - PRICE

The prices of the products listed on the Site are indicated in euros, inclusive of all taxes, but excluding shipping costs. For orders shipped to a country other than mainland France, you are considered the importer of the product(s) in question. All orders, regardless of origin, are payable in euros.

For orders shipped outside the EEC and French overseas territories, the product price will automatically be displayed excluding taxes. Customs duties, other local taxes, or import duties may be payable. These are your responsibility and are entirely at your own expense. These duties and amounts are not the responsibility of Kid Medical.

Kid Medical reserves the right to change its prices at any time. Products will be billed based on the rates in effect at the time the order is placed. Prices do not include a flat-rate processing fee (shipping, packaging, order preparation, and packing of your parcel(s)). This fee will be specified before you confirm your order. The fee depends on your chosen delivery method and address.

 

ARTICLE 3 - ORDER

Your order will be registered on the site provided that you register or log in to your account using your email address and password.

Item availability is indicated when you place your order. If not, a message will inform you of the restocking time from our supplier. In exceptional circumstances, a product may be temporarily unavailable when you place your order. Kid Medical will contact you by email to arrange either waiting for delivery from the supplier, an exchange for a product of similar or superior quality, or a refund.

Upon confirmation of your order, an email will be sent to you containing a summary of the products ordered, the billing and shipping addresses, and all other relevant information about your order. Your order will only be confirmed after receipt of your payment.

 

ARTICLE 4 - PAYMENT

Payment for your purchases is made at the time of order, either by:

Credit card payments are processed through our secure SSL portal: Visa, MasterCard, and other major credit cards. For privacy reasons, your credit card will appear on your bank statement as "KDM".
  • Cheque made payable to Kid Medical or postal order to be returned to: Bed Wet – ZA de Beauvent 22980 LA LANDEC - France
  • By Bank Transfer or Check: Your order will be shipped upon receipt of your payment. As soon as we receive your payment by check, money order, or bank transfer, you will receive an email confirming receipt of your payment and that your order is validated. The products remain the property of Kid Medical until full payment is received.

 

ARTICLE 5 - SHIPPING / DELIVERY

The ordered items, subject to availability, are shipped to the delivery address you provided during the ordering process.


Delivery is deemed to have been completed by Kid Medical upon the carrier's handover of the ordered products to the Customer. At that point, the risks associated with the products are immediately transferred to the Customer.


Shipping will be handled by an independent company. The Customer agrees to sign the delivery note. If the Customer is absent at the time of delivery, they have 9 to 15 business days (depending on the selected carrier) to collect the package from the carrier or collection point chosen by the Customer, starting from the date the delivery notice was left. In any case, the Customer will be informed as soon as possible when the products are available for collection.
 
Any package returned to Kid Medical because of an incorrect or incomplete delivery address, or because the Customer did not collect it from the carrier or depot within the period indicated in the preceding paragraph, will be reshipped at the Customer's expense.
 
Deliveries are made, whenever possible, within the estimated delivery times indicated on the Website, depending on the chosen delivery method, starting from the date of the order shipment confirmation email. In the event of a foreseeable delivery delay, Kid Medical will inform the Customer as soon as possible by email and provide an estimate of the additional delivery time.
 

For reasons of discretion, packages are sent under the sender name "KDM." Products are shipped the same day if your order is placed and paid for by credit card before noon, Monday to Friday (excluding public holidays), or at the latest 24 hours after receipt of the order and payment by check, postal order, or bank transfer. When your order is shipped, we will send you an email with your tracking number, which will allow you to track your package(s) at any time by logging into your account on our website. Deliveries within France will be made according to your order, namely:


  • Your parcel will be available for pickup within 24/48 hours at a DPD collection point of your choice (bakery, florist, dry cleaner, etc.). You will be asked to present proof of identity.
  • Delivery within 24/48 hours to your home, as selected when placing your order. Our carrier will contact you by SMS to arrange a delivery appointment (please provide your door code and/or intercom code so the drivers can access your mailbox).

Note: For payments by check, the order will be processed upon receipt of the check. Consequently, the applicable delivery times in this case are those in effect on the day the check is received and may therefore differ from those indicated on the day the order was placed.
 
For deliveries to Corsica, Monaco, French Overseas Departments and Territories, EEC and Non-EEC, the amount of shipping and packaging costs will be displayed on your order summary, before payment.
 
Note: Deliveries to countries outside the European Union may be subject to various fees and taxes, including customs duties and import VAT. These charges are the sole responsibility of the buyer.

For technical reasons, your order is sent in a single shipment. Therefore, if an item you ordered is temporarily out of stock, your entire order will be shipped as soon as we receive the missing item from our supplier.

Kid Medical reserves the right to change the shipping method depending on your order. Deliveries are tracked daily, Monday through Friday, by our team.


In the event of any problem with your delivery (loss, damage, missing package, etc.), please note any reservations on the carrier's delivery slip (e.g., badly damaged or open box). This slip, with your reservations, must be given to the carrier at the time of delivery. If you have any doubt about the contents of the package, refuse it and return the entire package to the carrier in its original packaging. Inform Kid Medical of this delivery issue on the same day so that a claim can be filed with the carrier within 24 hours.


If you fail to collect your parcel from a collection point within the holding period, you will be charged for the return shipping costs and any associated fees. If Predict is unable to deliver to your address after several unsuccessful attempts, you will be charged for the return shipping costs and any associated fees.

Kid Medical cannot initiate any proceedings without these mandatory instructions. For all deliveries outside the ground floor, delivery drivers are not obligated to bring the package upstairs. This remains at their discretion.

  • Please note that these are estimated delivery times and are not guaranteed. Bed Wet cannot be held responsible for the delivery time of your package.

ARTICLE 5.1 - FORCE MAJEURE

The following are considered force majeure events that release the seller from their obligation to deliver: war, riot, fire, strikes, accidents, and the impossibility of obtaining supplies. Goods always travel at the recipient's risk.

The customer is required to check their package upon arrival. They have 48 hours to report any missing or damaged items to the carrier.

ARTICLE 6 - RIGHT OF WITHDRAWAL

Pursuant to Article L. 211-18 of the Consumer Code, the Customer has a withdrawal period of fourteen (14) clear days from the date of receipt of the products ordered.
In the case of an order for several goods delivered separately or in the case of an order for a good consisting of multiple lots or parts whose delivery is staggered over a defined period, the period runs from the receipt of the last good or lot or the last part.
However, pursuant to Article L. 211-28 of the Consumer Code:
"The right of withdrawal cannot be exercised for contracts:"

  • Supply of goods made to the consumer's specifications or clearly personalized, such as items with ring closures or any other special request.
  • Supply of goods liable to deteriorate or expire rapidly
  • Supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection (Underwear, Washable nappies, Pyjamas, Bodysuits...)
  • The supply of goods which, after delivery, are, by their nature, inseparably mixed with other items
  • Of goods sold individually, such as diapers and pants;

To exercise their right of withdrawal, the Customer must, within the aforementioned period, send Kid Medical a registered letter with acknowledgment of receipt specifying their intention to exercise this right, or return the standard withdrawal form ( Download link ) to the address mentioned herein. They must also return a copy of the invoice corresponding to the returned products.

The Customer must return the products, at their sole expense, to the address mentioned herein, within fourteen (14) days of notifying their decision to withdraw, in their original packaging, unused and in perfect condition, without any marks or damage, with all labels, accessories, and any gifts that may have been included . It is imperative that the return be made in sturdy and securely sealed packaging to prevent damage during transport. Kid Medical will refuse the return of any product damaged as a result of such damage.

The Customer is reminded that, in accordance with the provisions of Article L. 221-23 of the Consumer Code, he may be held liable for any depreciation of the products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these products.

In the event of a return involving several products and if the Customer does not return all of the products, Kid Medical will deduct the price of the missing products from the amount to be refunded.

Kid Medical undertakes to reimburse the Client within fourteen (14) days from the date on which it is informed of the Client's decision to withdraw. However, Kid Medical is entitled to defer this reimbursement until the goods have been effectively received or until the Client has provided proof of shipment of these goods, whichever occurs first.
Kid Medical makes this refund using the same payment method as that used by the Client for the initial transaction, unless the Client expressly agrees to use another payment method and provided that the refund does not incur any costs for the Client.

Note: Orders over €99 qualify for free shipping via DPD. However, any return of part of an order that benefited from this free shipping will automatically result in a re-invoicing of shipping costs based on the remaining balance charged and the type of shipping service.


Product compliance fees:

  • For returned electronic items, a restocking fee of 25% of the product price will be charged if the product has been opened and/or used.
  • For returned clothing items, a restocking fee of 25% of the product price will be charged if the item has been opened. It must be returned in the same condition as when we delivered it to you, with its tag attached.

 

ARTICLE 7 - PIPI STOP RENTAL

Kid Medical on the Bed Wet Store website offers a rental service for customers in the following countries: France, Belgium and Switzerland.

The rental begins on the day of delivery of the device and ends on the day of receipt of the return of the complete device by our services (equipment, instruction manual and box).

Rental is subject to an initial 8-week rental agreement and will be billed separately (if necessary) in indivisible 4-week increments. The remaining balance will be billed upon receipt of the device or, failing that, every 4 weeks if the rented device is not returned. Rental of a bedwetting alarm is billed as a 4-week package according to the rates displayed on the product page. Any 4-week period that begins before the alarm is returned by our services will be charged in full.

The minimum rental period is 8 weeks. If the equipment is returned before this date, Kid Medical will deduct 8 weeks from the initial rental fee.

In the event of a breakdown of a rented device, please contact us so that we can arrange for a quick exchange to avoid an interruption in your child's treatment period.

Kid Medical offers a range of professional bedwetting alarms for the duration of your treatment. These alarms are not for sale unless you agree to purchase them during your treatment.

However, in the event of loss of the equipment or failure to return it in good condition, the Uriflex Liberty alarm or the vibrator will be charged to you based on the catalogue price visible on the website.
The price of a missing or non-functional probe will be charged at the list price shown on the website. These prices are not included in the initial basic rental agreement and will be billed separately.

Kid Medical is not responsible for the loss of the device during its return. We advise you to pack the equipment carefully in its original packaging and, if possible, use the shipping box you received. A tracking number (provided by your shipping provider) will be required for any claim. Return shipping costs are the responsibility of the customer unless otherwise stated on the website at the time of purchase. The Pipi Stop system rented during the rental period remains the property of Kid Medical and we ask you not to dismantle it, customize it during the rental period except for normal use during this period (adjustments and battery changes).

The deposit for the Pipi Stop system is refunded at the end of the rental period upon return of the complete alarm system and instructions . The deposit cannot be used to pay for additional rental weeks.

The rental service is independent of the Hamon Law and therefore cannot be returned upon receipt of the product. Kid Medical is available to advise you on renting a bedwetting alarm.

A fixed additional fee of €40 for recovery costs will be applied in accordance with Law 2012-387 of March 22, 2012, in the event of late payment. This fixed fee is also automatically due and payable without any reminder being necessary.

 

ARTICLE 8 - CUSTOMER SERVICE

ARTICLE 9A - LEGAL GUARANTEE

Kid Medical, whose registered office is located at ZA de Beauvent 22980 LA LANDEC, registered with the RCS of ST MALO under number 807 778 055 , in its capacity as seller, is liable for defects in conformity of the goods to the contract under the conditions of Article L. 217-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

In this respect, the Customer may make a claim under the legal guarantee of conformity or the guarantee against defects in the item sold by sending their claim to Kid Medical at the address mentioned above.

When acting under the legal guarantee of conformity, the Customer:

  • benefits from a period of two years from the delivery of the goods to take action;
  • may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
  • is exempt from providing proof of the existence of the lack of conformity of the goods during the 6 months following delivery of the goods. This period is extended to 24 months from 18 March 2016, except for second-hand goods.


The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

The Customer may decide to implement the warranty against hidden defects in the thing sold within the meaning of article 1641 of the Civil Code and in this case, he may choose between the termination of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.


No warranty claim will be possible if the customer has disassembled the product (watch, or alarm casing, with the exception of probes which have an opening flap).


Some items come with batteries. Bed Wet cannot guarantee their lifespan and recommends replacing them at the first sign of weakness with batteries of the same type and good quality.


ARTICLE 9B - AFTER-SALES SERVICE

Kid Medical offers a repair service to determine the cause of a malfunction and to repair it. Depending on the type of malfunction, a repair fee may apply (€20 per item minimum) unless a repair quote is accepted.

No parts initially changed for diagnostic or repair purposes will be returned or compensated.


ARTICLE 10 - INTELLECTUAL PROPERTY

All texts, comments, illustrations, and images reproduced on the Bed Wet website are protected by copyright and intellectual property rights worldwide. Therefore, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to any different or more restrictive provisions of the Intellectual Property Code.

Any other use constitutes infringement and is punishable under Intellectual Property law unless prior authorization is obtained from Kid Medical. Any reproduction, in whole or in part, of the Bed Wet website or any other element found on Kid Medical websites is strictly prohibited.

 

ARTICLE 11 - LIABILITY

Except as provided in Article 9, the Client is responsible for providing all necessary evidence to substantiate any defects or anomalies found. The Client must allow Kid Medical every opportunity to verify these defects or anomalies.

Subject to the exercise of any applicable right of withdrawal, all product returns must be expressly agreed to by Kid Medical. Products must be returned in perfect condition and in their original packaging with all accessories (including the instruction manual).
Depending on the circumstances, the return will result in either a replacement of the products or a refund to the Customer, after a quality and quantity check of the returned products. The costs and risks of shipping and return will be borne by the Customer if the non-conformity is not proven.

When Kid Medical is held liable as a result of its own fault, compensation is limited to direct, personal and certain damages suffered by the Client.

In any event, Kid Medical declines all responsibility, in particular with regard to the choice of products by the Customer or for damages resulting from modifications that may have been made to the products or resulting from a failure to follow the recommendations for use of the products.

Furthermore, it is noted that Kid Medical is not a producer, within the meaning of Articles 1245 et seq. of the Civil Code, of the products marketed via the Site.

Consequently, the supplier cannot be held liable for any damage to property and/or persons resulting from a product defect as defined in the aforementioned articles. Customers wishing to obtain compensation for such damages must therefore seek redress from the supplier in question.

Kid Medical cannot be held liable for any damage, temporary or permanent, caused to the Client's computer system, nor for any losses or damages that may be incurred, particularly as a result of accessing or browsing the Site. Data transmission via the Internet may result in errors and/or the Site not being continuously available. Consequently, Kid Medical cannot be held responsible for the availability or interruption of the online service.

Any item purchased using a voucher or discount voucher can only be refunded in the same form.

The user is informed that this automated processing of information, including the management of email addresses, has been declared to the CNIL (French Data Protection Authority) under number 1810968. The information and data concerning you are necessary for the registration and processing of your order. For complete discretion and out of respect for your privacy, your personal data is kept solely by Kid Medical for the purpose of processing your orders and is not transferred to any other company.

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify, and object to the processing of your personal data. You can send us an email indicating your surname, first name, and email address, or send us a letter to Bed Wet - ZA de Beauvent 22980 LA LANDEC, France.

Kid Medical stores, in particular, the personal addresses of users who have registered on the website on its servers. Kid Medical may use a system of cookies stored on the visitor's computer to improve their customer experience.

 

ARTICLE 13 - OBJECTION TO TELEPHONE SOLICITING

The Customer who provides their telephone contact details to Kid Medical via the Site when placing their online order is informed that they can register on a list to opt out of telemarketing (Bloctel list).


It is nevertheless specified that this registration does not prevent Kid Medical from contacting the Client by telephone for the strict purposes of the execution of this contract.

 

ARTICLE 14 - DISPUTE RESOLUTION

The Client declares that they have been previously informed by Kid Medical of the possibility of resorting, in the event of a dispute, to conventional mediation or any other alternative dispute resolution method.

The Customer may submit any dispute with our company to a consumer mediator. Pending the appointment of a mediator, Kid Medical refers you to the following link: http://www.economie.gouv.fr

Before contacting the mediator, the Client agrees to send their complaint to Kid Médical at the address indicated at the beginning of these general terms and conditions.

In the event of failure of the consumer dispute mediation procedure, or if the consumer Client does not wish to use this procedure, the parties will regain their freedom to bring the dispute before the competent courts.

In addition, Kid Medical informs the Client of the existence of the online dispute resolution platform set up by the European Commission and of the possibility of using it in the event of a dispute with Kid Medical in connection with this contract.

ARTICLE 15 - MANDATORY INFORMATION FOR CONSUMER CLIENTS

The articles L. 217-4, L. 217-5, L. 217-12 of the Consumer Code, as well as article 1641 and the first paragraph of article 1648 of the Civil Code, provisions which the Client expressly acknowledges having read prior to placing his order, are reproduced below.

Article L. 217-4 of the Consumer Code
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his supervision.

Article L. 217-5 of the Consumer Code
To comply with the contract, the goods must:

  • To be fit for the purpose for which goods of the same type are normally used and, where applicable:
  • correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
  • to present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;
  • Or present the characteristics defined by mutual agreement between the parties or be suitable for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter.


Article L. 217-12 of the Consumer Code

The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

Article 1641 of the Civil Code
The seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

Article 1648 of the Civil Code, paragraph 1
The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.
