What is the RQTH?
The RQTH (Reconnaissance de la Qualité de Travailleur Handicapé - Recognition of the Status of Disabled Worker), as it is known, enables people to be recognised as disabled workers. This gives access to a range of measures designed to promote the integration of disabled people into the world of work, both in terms of finding and keeping a job.
Who does it apply to?
A disabled worker is "any person whose possibilities of obtaining or keeping a job are effectively reduced as a result of the impairment of one or more physical, sensory, mental or psychological functions".
You must also be over 16.
How do you obtain it?
Recognition as a Disabled Worker (RQTH) is obtained by a decision of the Commission des Droits et de l'Autonomie des Personnes Handicapées (CDPAH). The aim is to obtain official recognition of the person's ability to work, based on his or her disability-related capacities.
If you are not in receipt of the AAH, you can apply to the Maison Départementale des Personnes Handicapées (MDPH) in your place of residence.
You must submit the following documents:
MDPH application form: Cerfa N°15692*01
The medical certificate: Cerfa 15695*01
And all the supporting documents requested on the form.
The application may be submitted by the disabled person or their legal representative.
But be patient, processing times can be fairly long and vary from one département to another. It takes around 6 months to obtain the RQTH.
The MDPHs are present in all the départements. They provide a public service to welcome, inform, guide and support disabled people.
But for how long?
The good news is that Decree No. 2018-1222 of 24 December 2018 makes it possible to extend the maximum duration for which certain rights can be granted to people with disabilities, as well as granting them without a time limit for people whose disability is unlikely to change for the better.
What are your advantages?
Recognition as a disabled worker entitles you to the following measures in particular:
referral by the CDAPH to an establishment or service providing assistance through work, to the labour market or to a vocational rehabilitation centre
Support from the Cap Emploi specialised placement network
Compulsory employment
Access to the civil service by competitive examination, with or without special arrangements, or by special contractual recruitment,
Assistance from Agefiph
Access to ENTHEA, giving you the opportunity to meet a RecruTHeur and find a job suited to your abilities and skills
Recognition as a disabled worker also gives you priority access to various employment and training support measures.
