Our General Terms and Conditions of Sale

This site is published by Kid Medical SARL with a capital of 1,000 euros, whose registered office is located at ZA de Beauvent 22980 LA LANDEC, registered with the RCS of ST MALO, under SIREN number: 807 778 055.

These general terms and conditions of sale govern the terms and conditions for placing orders on the Bed Wet site. Kid Medical reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force at the time of the order shall apply.

It is specified in advance that these conditions govern the sales made by Kid Medical of the products offered on the site known as the Bed Wet Store.

ARTICLE 1 - VALIDATION

You declare that you have read and accepted these general conditions of sale before placing your order. Confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale.

ARTICLE 2 - PRICES

The sale prices of the products mentioned on the Site are indicated in euros, inclusive of all taxes and excluding transport costs. In the event of an order to a country other than mainland France, you are considered to be the importer of the product(s) concerned. All orders, whatever their origin, are payable in Euros.

For orders dispatched outside the EEC and French overseas departments and territories, the price of the products will automatically be displayed exclusive of tax. Customs duties or other local taxes or import duties may be payable. These will be at your expense and are your sole responsibility. These rights and sums are not the responsibility of Kid Medical.

Kid Medical reserves the right to change prices at any time. The products will be invoiced on the basis of the rates in force at the time of registration of orders. Prices do not include a fixed contribution to processing costs (postage, packaging, preparation of your order and preparation of your (your) package). The amount will be indicated to you before your order is confirmed. This contribution depends on your delivery method and address.

ARTICLE 3 - ORDERING

Your order will be registered on the site provided that you register or log in to your account using your e-mail address and password.

You can place your order either :

  • by telephone on 09 52 94 21 09 from Monday to Friday, 9am to 4pm
  • or on (+33) 9 52 94 21 09 from abroad or DOM TOM from Monday to Friday from 9am to 4pm


You will be informed of the availability of items when you place your order. If not, you will receive a message telling you how long it will take our supplier to restock. Exceptionally, it may happen that a product is temporarily unavailable at the time of your order. Kid Medical undertakes to contact you by e-mail to agree with you either to wait for the supplier's delivery, or to exchange the product for one of similar or higher quality, or to reimburse you.

When your order is validated, an e-mail is sent to you with a summary of the products ordered, the billing and delivery address and all the information relating to your order. Your order will not be validated until we have received your payment.

ARTICLE 4 - PAYMENT

Payment for your purchases is made at the time of ordering either by :

Credit card on our secure SSL space: Visa, MasterCard, Other credit cards. For reasons of discretion, the name of your credit card on your bank statement will appear under the name "KDM".
  • Cheque made payable to Kid Medical or Postal Order to be returned to us at : Bed Wet - ZA de Beauvent 22980 LA LANDEC - France
  • By bank transfer or cheque: Your order will be dispatched on receipt of your payment. Upon receipt of your payment by cheque, money order or bank transfer, you will receive an e-mail indicating that your payment has arrived and that your order has been validated. The products remain the property of Kid Medical until full payment of the price.

ARTICLE 5 - DISPATCH / DELIVERY

The items ordered, subject to availability, are shipped to the delivery address you specified during the ordering process.


Delivery is deemed to have been made by Kid Medical when the products ordered are handed over to the Customer by the carrier. Then, the risks of the products are immediately transferred to the Customer.


Transport will be carried out by an independent company. The Customer undertakes to sign the delivery note for the products. If the Customer is absent at the time of delivery, they have a period of 9 to 15 working days (depending on the carrier selected) to collect the parcel from the carrier or agent chosen by the Customer, as from the date of the delivery notice. In any event, the Customer will be informed as soon as possible of the availability of the products.
Any package returned to Kid Medical because of an incorrect or incomplete delivery address, or because the Customer would not withdraw from the carrier or custodian within the period specified in the preceding paragraph, will be resent at the expense of the Customer.
Deliveries are made, as far as possible, according to the indicative times indicated on the Site depending on the delivery method chosen, from the date of sending of the e-mail confirming that the order has been placed for delivery. In the event of a foreseeable delay in delivery, Kid Medical will inform the Customer as soon as possible by e-mail and will provide an estimate of the additional delivery time.

For reasons of discretion, packages are sent under the sender's name "KDM". Products are dispatched the same day if your order is placed and paid for by credit card before 12 noon, Monday to Friday (excluding public holidays), or at the latest 24 hours after receipt of the order and payment by cheque, postal order or bank transfer. When your order is dispatched, we will send you an e-mail indicating your tracking number, which will enable you to track your parcel(s) whenever you wish, by logging into your account on our website. Deliveries in France will be made according to your order:


  • Within 24/48 hours at a DPD delivery point of your choice (bakery, florist, dry cleaner, etc.). Your parcel will be available and will be given to you on presentation of an identity document.
  • Within 24/48 hours at your home address, depending on your choice when placing your order. Our carrier will contact you by SMS to arrange an appointment for the delivery of your order (please indicate your door and/or intercom code so that the drivers can access your letterbox).

NB: In the case of payment by cheque, the order will be processed on receipt of the cheque. Consequently, the delivery times applicable in this case are those on the day the cheque is received and may therefore be different from those stated on the day the order is placed.
For deliveries to Corsica, Monaco, French Overseas Departments and Territories, EEC and non-EEC countries, the cost of postage and packaging will be displayed on the summary of your order, before payment.
NB: Please note that deliveries to countries outside the European Union may be subject to various charges and taxes, in particular customs duties and import VAT. These costs are borne exclusively by the buyer.

For technical reasons, your order will be sent in a single shipment. Therefore, in the event of a temporary shortage of an item that you have ordered, your order will be dispatched in full as soon as we receive the missing item from our supplier.

Kid Medical reserves the right to change the shipping method depending on your order. Deliveries are monitored every day, from Monday to Friday, by our services.


In the event of any anomaly concerning your delivery (loss, damage, 1 package missing, etc.), please indicate any reservations you may have on the carrier's delivery note (e.g. very damaged or open box, etc.). This delivery note with your reservations must be given to the carrier at the time of delivery. If in doubt about the contents of the package, refuse it and return the package to the carrier in its entirety and in its original box. You should inform Kid Medical of this delivery incident on the same day so that we can initiate a procedure with the carrier within 24 hours.


If your parcel is not collected from a collection point after the time limit, you will be billed for the costs and incidents involved in returning it. If Predict is unable to deliver your parcel to you after several attempts have gone unanswered, you will be invoiced for the costs and incidents involved in returning the parcel.

Kid Medical will not be able to initiate any procedure without these imperative instructions. For all deliveries outside the ground floor, the deliverers are not obliged to deliver the package upstairs. This is at their discretion.

  • Please note that these are estimated times and not guaranteed.Bed Wet cannot be held responsible for the delay in delivery of your parcel.

ARTICLE 5.1 - FORCE MAJEURE

The following are considered to be cases of force majeure releasing the seller from its obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied. Goods are always transported at the recipient's risk.

The customer must check his parcel on arrival. They have 48 hours in which to make any reservations to the carrier in the event of shortages or damage.

ARTICLE 6 - RIGHT OF WITHDRAWAL

In application of article L. 211-18 of the French Consumer Code, the Customer has a right of withdrawal of fourteen (14) clear days from the date of receipt of the products ordered.
In the case of an order for several goods delivered separately or in the case of an order for a good made up of multiple batches or parts whose delivery is staggered over a defined period, the period runs from receipt of the last good, batch or part.
However, in accordance with article L. 211-28 of the French Consumer Code:
"The right of withdrawal may not be exercised for contracts :

  • The supply of goods made to the consumer's specifications or clearly personalised, such as items with a ring fastener or any other special request.
  • The supply of goods that are likely to deteriorate or expire rapidly.
  • The supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection (underwear, washable nappies, pyjamas, bodysuits, etc.).
  • The supply of goods which, after delivery and by their nature, are indissociably mixed with other items
  • Goods sold individually, such as nappies and pants".

To exercise its right of withdrawal, the Customer must, within the period indicated above, send to Kid Medical, a registered letter with acknowledgment of receipt stating its desire to use this right or return the standard form for exercising the right of withdrawal (Download Link) to the address mentioned herein. The Customer must also return a copy of the invoice corresponding to the products returned.

The Customer must return the products, at his/her exclusive expense, to the address mentioned herein, within fourteen (14) days of communicating his/her decision to withdraw, in their original packaging, unused and in perfect condition, without any trace or mark, with the labels, all accessories and any gifts that may have been offered. It is imperative that the return is made in a solid and well-sealed package to avoid it being damaged during transport. If a product is returned damaged in this way, Kid Medical will refuse the return.

In this respect, the Customer is reminded that, in accordance with the provisions of Article L. 221-23 of the Consumer Code, it may be held liable in the event of depreciation of the products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these products.

In case of withdrawal of several products and if the Customer does not return all products, Kid Medical will deduct from the sum to be refunded, the price of missing products.

Kid Medical undertakes to reimburse the Customer within fourteen (14) days from the date on which it is informed of the Customer's decision to withdraw. However, Kid Medical is entitled to defer this refund until the actual recovery of the goods or until the Customer has provided proof of shipment of these goods, the date retained is that of the first of these facts.
Kid Medical makes this refund using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed by the Customer to use another means of payment and insofar as the refund does not incur costs for the Customer.

NB: Orders over €99 benefit from free delivery by DPD. However, any return of a part of the order benefiting from this free delivery service will systematically result in the re-invoicing of delivery charges indexed to the remaining balance invoiced and the type of delivery service.


Costs for restoring products to conformity :

  • For returned electronic items, a restocking fee of 25% of the product price will be charged if the product has been opened and/or used.
  • For returned clothing items, a restocking fee of 25% of the product price will be charged if the product has been opened. The item must be returned as delivered with its label.

ARTICLE 7 - PIPI STOP HIRE

Kid Medical on the Bed Wet Store site offers a rental service for customers in the following countries: France, Belgium and Switzerland.

The rental begins on the day of delivery of the device and ends on the day of receipt of the return of the complete device by our services (equipment, instructions for use and box).

Rental is subject to an initial rental agreement of 2 months and will be subject to additional invoicing (if necessary) each week in arrears. The balance will be invoiced on receipt of the device or every 1 month if the rented device is not returned. The rental of a pipi stop is invoiced on a monthly basis according to the rates shown on the product sheet. Any month started before the return of the alarm by our services will be deducted in full.

The minimum rental period is 2 months. If the alarm is returned before this date, Kid Medical will deduct 2 months from the initial package.

In the event of breakdown of a rented device, please contact us so that we can exchange it quickly to avoid interrupting your child's treatment period.

Kid Medical offers a range of professional Pipi Stop alarms for the duration of the treatment. These alarms are not for sale unless you agree during the treatment.

However, if the equipment is lost or not returned in good condition, the Uriflex Liberty alarm or vibrator will be invoiced to you on the basis of the list price visible on the site.
The price of a missing or non-functional probe will be invoiced at the list price visible on the site. The prices shown are not included in the initial basic rental contract and will be invoiced separately.

Kid Medical is not responsible for the loss of the device during its return. We advise you to pack the equipment securely in its original packaging and, if possible, to use the shipping carton you received. A tracking number (provided by your shipping company) will be required for any claim. The customer is responsible for the cost of returning the goods, unless otherwise indicated on the site when the contract was concluded. The return address is: Kid Medical - ZA de Beauvent - 22980 LA LANDEC.

The Pipi Stop system rented during the rental period remains the property of Kid Medical and we ask that you do not dismantle or customise it during the rental period with the exception of normal use during this period (adjustments and battery changes).

The deposit for the supply of the Pipi Stop system will be returned at the end of the hire period and on return of the alarm complete with instructions. The deposit will not be used to pay for additional weeks of hire.

The rental service is independent of the Hamon law and therefore cannot be returned on receipt of the product. Kid Medical is at your disposal to advise you on the rental of a pee stop.

An additional fixed indemnity for collection costs of €40 will be applied in accordance with Law 2012-387 of 22 March 2012 in the event of late payment. This flat-rate compensation is also payable automatically and without the need for a reminder.

ARTICLE 8 - CUSTOMER SERVICE

For any information or questions relating to the tracking of your order, our Customer Service department is at your disposal by telephone: 09 52 94 21 09 (Monday to Friday, 9.30am to 5.30pm) or by e-mail.

ARTICLE 9A - LEGAL GUARANTEE

Kid Medical, whose registered office is located at ZA de Beauvent 22980 LA LANDEC, registered in the ST MALO Trade and Companies Register under number 807 778 055, in its capacity as seller, is liable for defects in conformity of the goods with the contract under the conditions of article L. 217-4 et seq. of the French Consumer Code and for hidden defects in the goods sold under the conditions set out in articles 1641 et seq. of the French Civil Code.

As such, the Customer may make a claim under the legal guarantee of conformity or the guarantee of defects in the item sold by sending his complaint to Kid Medical at the address given above.

When acting under the legal guarantee of conformity, the Customer :

  • has a period of two years from delivery of the goods to take action;
  • may choose between repairing or replacing the good, subject to the cost conditions set out in article L. 217-9 of the Consumer Code;
  • is exempt from having to prove the existence of a lack of conformity in the goods for a period of 6 months following delivery of the goods. This period is extended to 24 months from 18 March 2016, except for second-hand goods.


The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

The Customer may decide to invoke the guarantee against hidden defects in the item sold within the meaning of article 1641 of the French Civil Code, in which case he or she may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.


No guarantee will be possible if the customer has dismantled the product (watch or alarm box, with the exception of sensors which have an opening flap).


Some items are delivered with batteries. Bed Wet cannot guarantee their lifespan and recommends that you replace them at the first sign of weakness with batteries of the same reference and of good quality.


ARTICLE 9B - SERVICE

Kid Medical offers an after-sales service to determine the cause of a breakdown and its repair. Depending on the type of breakdown, an after-sales service charge may be applied (a minimum of €20 per item) unless a repair estimate is agreed as proposed.

No part initially changed for diagnostic or repair purposes will be returned or compensated.


ARTICLE 10 - INTELLECTUAL PROPERTY

All texts, comments, illustrations and images reproduced on the Bed Wet site are reserved under copyright and intellectual property law for the entire world. For this reason and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorised, subject to different or even more restrictive provisions of the Intellectual Property Code.

Any other use constitutes an infringement and is punishable under the Intellectual Property unless prior authorization of Kid Medical. Any total or partial reproduction of the Bed Wet site or any other part of the elements found on the Kid Medical sites is strictly prohibited.

ARTICLE 11 - LIABILITY

Except in the case referred to in Article 9, it is the Customer's responsibility to provide any justification as to the reality of the defects or anomalies observed. It must allow Kid Medical every facility to proceed with the observation of these defects or anomalies.

Subject to the exercise of the right of withdrawal, any return of product must be expressly agreed by Kid Medical. Products must be returned in perfect condition and in their original packaging with all accessories (including instructions).
The return will give rise, depending on the case, to a replacement of the products or a refund to the Customer, after verification of the quality and quantity of the products returned. The costs and risks of shipping and return will be charged to the Customer if the non-compliance is not proven.

When the responsibility of Kid Medical is engaged following a fault on its part, compensation applies only to direct damage, personal and certain that the Customer has suffered.

In any event, Kid Medical disclaims any liability, including as to the choice of products by the Customer or due to damage resulting from changes that would have been made to the products or resulting from a failure to recommendations for use of products.

In addition, it is recalled that Kid Medical is not producer, within the meaning of Articles 1245 et seq of the Civil Code, products marketed via the Site.

Consequently, Kid Medical cannot be held liable in the event of damage caused to property and/or persons due to a defect in the products within the meaning of the aforementioned articles. The Customer wishing to obtain compensation for such damage must therefore seek the responsibility of the supplier concerned.

Kid Medical can not be held responsible for damage, temporary or permanent, caused to the computer system of the Customer or any loss or damage that may be suffered in particular following access or navigation on the Site. The transmission of data via the Internet can lead to the appearance of errors and / or the fact that the site is not always available. Therefore, Kid Medical can not be held responsible for the availability and interruption of online service.

Any item purchased using a voucher or a discount voucher can only be reimbursed in the same form.

ARTICLE 12 - RESPECT FOR PRIVACY

Users are informed that this automated processing of information, in particular the management of e-mail addresses, has been declared to the CNIL under number 1810968 . The information and data concerning you are necessary for the registration and follow-up of your order. For total discretion and out of respect for privacy, your personal data is kept solely by Kid Medical in connection with your orders, and is not passed on to any other company.

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access and rectify any personal data concerning you, and to object to the processing of such data. You can send us an e-mail indicating your surname, first name and e-mail address, or send us a letter to Bed Wet- ZA de Beauvent 22980 LA LANDEC.

Kid Medical stores on its servers the personal addresses of users who have registered on the website. Kid Medical may use a system of cookies stored on the visitor's computer to improve the customer experience.

ARTICLE 13 - OPPOSITION TO TELEPHONE CANVASSING

The Customer who communicates his telephone details to Kid Medical via the Site when ordering online, is informed that he can register on a list of opposition to telephone canvassing (Bloctel list).


It is nevertheless specified that this registration does not prohibit Kid Medical to contact the Customer by phone for the strict needs of the execution of this contract.

ARTICLE 14 - SETTLEMENT OF DISPUTES

The Client declares that it has been informed in advance by Kid Medical of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method.

The Customer may submit any dispute with our company to a consumer mediator. Pending his appointment, Kid Medical refers to the following link: http: //www.economie.gouv.fr

Before referring to the mediator, the Customer undertakes to send his complaint to Kid Medical at the address given at the beginning of these general conditions.

In case of failure of the mediation procedure for consumer disputes, or if the Customer consumer does not wish to use this procedure, the parties will regain their freedom to bring the dispute before the competent courts.

In addition, Kid Medical informs the Customer of the existence of the platform for online settlement of disputes set up by the European Commission and the possibility of using it in case of dispute with Kid Medical in connection with this contract.

ARTICLE 15 - COMPULSORY INFORMATION FOR CONSUMER CUSTOMERS

The following are articles L. 217-4, L. 217-5 and L. 217-12 of the French Consumer Code, as well as article 1641 and the first paragraph of article 1648 of the French Civil Code, provisions of which the Customer expressly acknowledges having read prior to placing an order.

Article L. 217-4 of the Consumer Code
The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was his responsibility under the contract or was carried out under his responsibility.

Article L. 217-5 of the French Consumer Code
To conform to the contract, the goods must :

  • Be fit for the use normally expected of similar goods and, where applicable :
  • correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
  • have the qualities that a buyer may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
  • Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.


Article L. 217-12 of the French Consumer Code

Any action arising from a lack of conformity must be brought within two years of delivery of the goods.

Article 1641 of the French Civil Code
The seller is liable for any hidden defects in the item sold that render it unfit for its intended use, or that impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.

Article 1648 of the Civil Code, paragraph 1
The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.
